REGA Spokesperson: Owner Association Fees Aren't Mandatory

The spokesperson for the Real Estate General Authority (REGA), Taysir Al-Mufarrij, has clarified that recent information circulated about owner association fees is inaccurate. He stated that the Real Estate Unit Ownership, Subdivision, and Management Law and its executive regulations do not specify a fixed percentage or value for these fees.

Al-Mufarrij explained that the section being circulated online is from a non-binding, illustrative template for owner association bylaws. These examples are subject to approval by the association's members, including owners and occupants of shared units, to ensure rights are protected, shared property is well-maintained, and a culture of mutual coexistence is fostered.

He further detailed that the purpose of the owner association bylaws is to regulate the operations of associations for shared real estate units. These bylaws define the administrative structure, decision-making processes, membership requirements, the general assembly's jurisdiction, and the board of directors' duties. They also cover member rights and obligations, subscription fees, the management and maintenance of shared areas, revenue and expense regulations, penalties, and dispute resolution methods. Al-Mufarrij emphasized that this document is a prerequisite for registering an association, as per Article (12) of the Real Estate Unit Ownership, Subdivision, and Management Law.
